- Novell Settles Trademark Infringement Action
-
- Assures Students Get Authorized Education Classes
-
- PROVO, Utah -- March 23, 1992 -- Novell today announced it settled a
- trademark infringement action against Network Systems and Services, Inc., a
- New York-based computer training company, to assure computer network users
- and resellers get legitimate, quality education classes offered under
- Novell trademarks.
-
- After receiving numerous complaints from students, Novell filed a lawsuit
- against NSSI in October 1991 in Federal District Court in New York City.
- NSSI had been fraudulently representing itself as a Novell Authorized
- Education Center. In the lawsuit, it was alleged that NSSI improperly
- assured students that its classes were sanctioned by Novell, allowed
- untrained and uncertified instructors to teach classes about Novell
- software, used inadequate computer equipment and utilized counterfeit
- Novell course materials.
-
- "Our customers and resellers look to Novell Authorized Education Centers
- for training because they recognize that only those companies meeting
- certain standards and conditions are awarded this prestigious designation,"
- said David Bradford, Novell senior vice president and general counsel. "It
- is essential that we protect the investment they make in education by
- ensuring that the courses taken under the Novell trademark are legitimate
- and of the quality associated with Novell training."
-
- As part of the settlement against NSSI, the training company agreed to make
- an undisclosed payment to students and consented to a final judgment and
- permanent injunction, barring them from using Novell's registered
- trademarks and trade name without permission. NSSI has also terminated the
- employment of an instructor who was making counterfeit copies of Novell
- course materials. In the future, NSSI will specifically advise all students
- prior to registration that NSSI is not a Novell Authorized Education
- Center.
-
- "20,000 end users and resellers per month take classes in network computing
- from more than 600 Novell Authorized Education Centers worldwide," said
- Carolyn Rose, director of education at Novell. "These students rely on
- NAEC courses to gain understanding of the complexities of networking.
- Because the subject is sophisticated, we take great care to ensure that the
- classes are taught by certified instructors in well-equipped facilities
- using Novell-developed materials."
-
- Novell, Inc. (NASDAQ: NOVL) is an operating system software company, the
- developer of network services, specialized and general purpose operating
- system software products including NetWare and DR DOS. Novell's NetWare
- network computing products manage and control the sharing of services, data
